By accessing or using Intake Studio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Intake Studio is a web-based platform that enables users to create, publish, and manage client intake forms. The Service includes a visual form editor, AI-powered form generation, submission management, and related features.

3. Accounts

To use certain features you must create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep it up to date.

4. User Content

You retain ownership of all content you create through the Service, including intake forms, questions, and uploaded media ("User Content"). By using the Service, you grant Intake Studio a non-exclusive, worldwide license to host, store, and display your User Content solely for the purpose of providing the Service.

You are solely responsible for the legality, reliability, and appropriateness of the User Content you create or collect through intake forms.

5. Submission Data

Submission data collected from your intake forms is stored on your behalf. You are the data controller for any personal information collected through your intake forms and are responsible for complying with applicable data-protection laws.

6. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation.
Collect personal information from minors without parental consent.
Distribute malware or engage in phishing.
Impersonate another person or entity.
Interfere with or disrupt the integrity or performance of the Service.
Attempt to gain unauthorized access to any part of the Service.

7. Payments & Subscriptions

Certain features may require a paid subscription. Payments are processed through Stripe. By subscribing to a paid plan you agree to pay the applicable fees. Subscriptions automatically renew unless cancelled before the end of the current billing period. Refunds are handled on a case-by-case basis.

8. Intellectual Property

The Service, including its original content (excluding User Content), features, and functionality, is and will remain the exclusive property of Intake Studio and its licensors. The Service is protected by copyright, trademark, and other laws.

9. Termination

We may terminate or suspend your account at any time, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

10. Limitation of Liability

To the maximum extent permitted by law, Intake Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Disclaimer

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.
